Terms of Service

The terms and conditions governing your use of the Sofla AI mortgage qualification platform.

1. Acceptance of Terms

By accessing or using the Sofla platform ("Platform"), operated by Minecore Group ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. We reserve the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

2. Platform Description

Sofla is an AI-powered mortgage qualification platform that provides:

  • Automated borrower pre-qualification through an AI-driven assessment
  • Loan program matching across FHA, Conventional, Jumbo, Bank Statement, Foreign National, Fix & Flip, and Reverse Mortgage products
  • Qualification scoring and risk assessment
  • Document checklist generation and tracking
  • Borrower-to-lender routing within our participating lender network

Important: Sofla is a technology platform that facilitates the mortgage qualification process. We are not a lender, mortgage broker, or financial advisor. We do not make lending decisions, guarantee loan approval, or provide financial advice. All lending decisions are made by participating lenders in our network.

3. User Accounts

To access certain features of the Platform, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information during registration and qualification
  • Maintain and promptly update your account information to keep it accurate
  • Maintain the security of your password and account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that contain inaccurate information, are used fraudulently, or violate these Terms.

4. Acceptable Use

You agree not to use the Platform to:

  • Submit false, misleading, or fraudulent information during the qualification process
  • Misrepresent your identity, income, employment, assets, or debts
  • Attempt to manipulate qualification scores or AI assessments
  • Access or attempt to access other users' accounts or data
  • Interfere with or disrupt the Platform's infrastructure, security, or functionality
  • Use automated tools, bots, or scrapers to access the Platform without our written consent
  • Violate any applicable local, state, or federal law or regulation
  • Use the Platform for any purpose other than legitimate mortgage qualification

Submitting false information during a mortgage qualification process may constitute federal mortgage fraud, which is punishable under 18 U.S.C. 1014 by fine or imprisonment of up to 30 years, or both.

5. AI Qualification and Scoring

The Platform uses artificial intelligence to assess borrower qualification. By using the AI qualification feature, you acknowledge and agree that:

  • AI-generated qualification scores are preliminary assessments, not lending decisions
  • Scores and loan program matches are based on the information you provide and may change if that information changes
  • A high qualification score does not guarantee loan approval from any lender
  • Final lending decisions are made solely by participating lenders based on their own underwriting criteria
  • AI assessments may identify red flags or inconsistencies that could affect your application

6. Intellectual Property

All content, features, and functionality of the Platform are owned by Minecore Group and are protected by copyright, trademark, and other intellectual property laws. This includes but is not limited to:

  • The Sofla name, logo, and brand elements
  • AI qualification algorithms and scoring methodologies
  • Platform design, user interface, and user experience
  • Educational content, guides, and Academy materials
  • Software code, APIs, and technical infrastructure

You may not reproduce, distribute, modify, or create derivative works from any part of the Platform without our prior written consent.

7. Limitation of Liability

To the fullest extent permitted by law:

  • The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We do not warrant that the Platform will be uninterrupted, error-free, or secure.
  • We are not liable for any decisions made by lenders in our network regarding your mortgage application.
  • We are not responsible for the accuracy of AI-generated assessments, scores, or recommendations beyond the information you provide.
  • In no event shall Minecore Group be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
  • Our total liability for any claim related to the Platform shall not exceed the amount you have paid to us in the twelve months preceding the claim, or $100, whichever is greater.

8. Indemnification

You agree to indemnify and hold harmless Minecore Group, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your submission of false or misleading information during the qualification process.

9. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Reasons for termination may include:

  • Violation of these Terms or applicable law
  • Submission of fraudulent or misleading information
  • Conduct that is harmful to other users, lenders, or the Platform
  • Extended inactivity on your account

You may terminate your account at any time by contacting us at hello@sofla.ai. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or your use of the Platform shall be resolved as follows:

  • Informal resolution: You agree to first attempt to resolve any dispute informally by contacting us at hello@sofla.ai. We will attempt to resolve the dispute within 30 days.
  • Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association.
  • Class action waiver: You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
